General Terms and Conditions of Contract and Sale

1. GENERAL INFORMATION

These General Terms and Conditions govern the purchase of merchandising products made through the official Bastian Beach online store (hereinafter, the "Website").

Placing an order through the Website implies full acceptance of these General Terms and Conditions of Contract and Sale.

2. THE USER

The User declares to be over 18 years of age and to have sufficient legal capacity to enter into contracts.

The User also agrees to provide truthful, complete, and up-to-date information during the purchase process.

3. PRODUCTS

The Website sells official Bastian Beach merchandising products.

Product photographs, colors, and descriptions are for guidance purposes only. Although Bastian Beach strives to ensure they accurately reflect reality, slight variations may occur due to how they are displayed on different devices or due to manufacturing processes.

All orders are subject to stock availability.

If a product is unavailable after an order has been placed, Bastian Beach will inform the customer as soon as possible and will issue a full refund of the amount paid.

4. PURCHASE PROCESS

The User may select the desired products and add them to the shopping cart.

Once payment has been completed, the User will receive a confirmation email with a summary of the order.

Acceptance of the order is subject to product availability.

5. PRICES AND PAYMENT METHODS

All prices are expressed in Euros (€) and include VAT and any legally applicable taxes.

Payments are made through the secure payment gateways available on Shopify.

6. ORDER PICKUP

Bastian Beach currently does not offer home delivery.

All orders must be collected exclusively at our physical store located at:

The customer will receive an email once their order is ready for pickup.

To collect the order, the confirmation email and a valid form of identification may be requested.

Orders will remain available for pickup for 15 calendar days from the date of the availability notification.

If the order has not been collected within this period, Bastian Beach may cancel the order and refund the amount paid, deducting, where applicable, any reasonable costs arising from the order management, provided this is permitted under applicable law.

7. EXCHANGES, RETURNS, AND RIGHT OF WITHDRAWAL

In accordance with Royal Legislative Decree 1/2007, consumers have a period of 14 calendar days from the collection of the order to exercise their right of withdrawal.

Returns must be made in person at the Bastian Beach store, following prior notification by email to info@bastianbeach.com, stating the order number.

For a return to be accepted, products must meet the following conditions:

• Be in perfect condition.
• Not have been used, washed, or show signs of use.
• Retain all original tags and, where applicable, their original packaging.
• Be complete and in the same condition in which they were delivered.

Bastian Beach reserves the right to refuse a return when the product shows clear signs of use, damage, or tampering, or does not retain its original tags.

Returns of products made to customer specifications or clearly personalized items will not be accepted.

Likewise, for health and hygiene reasons, returns of bikinis, swimsuits, or other swimwear that have been unsealed or whose hygiene seal has been removed after delivery will not be accepted, in accordance with applicable law.

Once a return has been accepted, the refund will be issued using the same payment method used for the purchase.

8. DEFECTIVE PRODUCTS OR INCORRECT DELIVERY

If the customer receives a defective, damaged, or incorrect product, they must notify Bastian Beach as soon as possible via the contact email.

In such cases, Bastian Beach will proceed, as applicable, to replace the product, repair it, or refund the amount paid, in accordance with applicable law.

9. LEGAL WARRANTY

All products sold by Bastian Beach carry the legal warranty provided for under Spanish consumer protection law.

10. LIABILITY

Bastian Beach shall not be liable for delays or failures resulting from force majeure or circumstances beyond its control.

Likewise, it shall not be liable for damage resulting from improper use of the purchased products.

11. MODIFICATION OF THE TERMS AND CONDITIONS

Bastian Beach may modify these General Terms and Conditions at any time. The applicable terms will be those in force on the date the order is placed.

12. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions shall be governed by Spanish law.

Any dispute shall be submitted to the Courts and Tribunals with jurisdiction in accordance with applicable consumer protection regulations.
